Terms & Conditions FOR RENTALs

Please read these Terms and Conditions carefully before making a booking with PlayHaus. By placing a booking you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, please do not proceed with a booking.

01 DEFINITIONS

In these Terms and Conditions, the following words have the meanings set out below:

- "PlayHaus", "we", "us", "our" — PlayHaus, a rental company operating in London, United Kingdom.
- "Customer", "you", "your" — the individual or entity making a booking with PlayHaus.
- "Equipment" — any item, product, or asset provided by PlayHaus under a rental agreement, including but not limited to PlayStation consoles, DualSense controllers, and game discs.
- "Rental Period" — the agreed duration for which Equipment is hired, as confirmed in your booking.
- "Booking Confirmation" — the written or electronic confirmation issued by PlayHaus upon acceptance of your order.
- "Security Hold" — a pre-authorisation placed on your payment method for the duration of the Rental Period. No funds are captured or charged; the hold is released automatically once the Equipment is returned in satisfactory condition.

02 RENTAL AGREEMENT & BOOKING TERMS

2.1 How a Booking is Made: A booking is made when you submit an order through our website, by email, or by any other method we make available. A booking is only confirmed once you receive a written Booking Confirmation from PlayHaus and the required hold or full payment has been received.

2.2 Your Obligations: By making a booking, you confirm that: 

- You are at least 18 years of age. 

- All information provided during booking is accurate and complete. 

- You have the legal authority to enter into this agreement on behalf of yourself or the organisation you represent. 

- The Equipment will be used solely for its intended purpose and in a lawful manner. 

- You will not sub-hire, lend, or transfer the Equipment to any third party without our prior written consent.

2.3 Equipment Availability: All Equipment is subject to availability. PlayHaus reserves the right to substitute Equipment of equivalent or superior specification in the event that the specific item booked becomes unavailable. We will notify you in advance where possible.


2.4 Delivery & Collection: Delivery and collection times will be agreed at the point of booking. You must ensure safe and clear access to the delivery location. PlayHaus accepts no liability for delays caused by circumstances outside our reasonable control, including but not limited to traffic, weather, or access restrictions.

2.5 Late Returns: Equipment must be returned or made available for collection at the agreed time. Late returns may incur additional charges at our standard daily rental rate, pro-rated for the period of delay. We will notify you of any such charges as soon as reasonably practicable.

2.6 Modifications to Bookings: Any request to modify a confirmed booking (including changes to dates, Equipment, or delivery location) must be made in writing to playhaussupport@gmail.com. We will accommodate changes where possible but cannot guarantee availability. Additional charges may apply.

03 PAYMENT, HOLDS & REFUNDS

3.1 Pricing: All prices are quoted in Pounds Sterling (£) and are inclusive of VAT where applicable. PlayHaus reserves the right to amend pricing at any time; however, the price confirmed in your Booking Confirmation will not change after that point.

3.2 Payment Terms: A required hold (as stated at the time of booking) is required to confirm your booking. The remaining balance must be paid in full no later than 48 hours before the start of the Rental Period, unless otherwise agreed in writing. Failure to make payment on time may result in cancellation of your booking.

3.3 Accepted Payment Methods: We accept payment by bank transfer, debit card, and credit card. All payment details will be provided during the booking process.

3.4 Security Hold: PlayHaus may place a Security Hold on your payment method prior to the commencement of the Rental Period. The hold amount will be communicated at the time of booking. No funds are captured or charged - this is a pre-authorisation only. The Security Hold will be released within 3–5 business days of the Equipment being returned and inspected, provided no damage, loss, or outstanding charges apply. If damage or loss is confirmed (see Section 4.2), PlayHaus reserves the right to capture all or part of the held amount to cover those costs.

3.5 Cancellation Policy: Cancellation charges are calculated as follows:

- More than 48 hours before the Rental Period: Full refund of any payments made. No charges apply. 

- 24–48 hours before the Rental Period: 50% of the total booking amount is charged. The remaining 50% will be refunded. 

- Less than 24 hours before the Rental Period: 100% of the total booking amount is charged. No refund will be issued. 

 

Cancellations must be made in writing to playhaussupport@gmail.com. The date of cancellation is the date we receive your written notification.

3.6 Cancellation by PlayHaus: In the unlikely event that PlayHaus cancels a booking (other than due to your breach of these Terms), we will provide a full refund of all sums paid, including any booking hold. This will be your sole remedy and PlayHaus will not be liable for any indirect or consequential loss arising from such cancellation.

04 DAMAGE, LIABILITY & INSURANCE

4.1 Care of Equipment: You are responsible for the Equipment from the time of delivery or collection until it is returned to PlayHaus or collected by us. You must take reasonable care of the Equipment and ensure it is used only for its intended purpose, in accordance with any instructions provided.

4.2 Damage & Loss: You will be charged for any damage to, or loss or theft of, Equipment during the Rental Period. Charges will reflect the cost of repair or full replacement at current market value, as determined by PlayHaus. We will provide you with a written breakdown of any charges captured from the Security Hold or invoiced separately.

Fair wear and tear is accepted and will not be charged. PlayHaus reserves the right to assess the condition of returned Equipment before releasing the Security Hold.

4.3 Prohibited Use: You must not: 

​

- Use the Equipment in a manner that is dangerous, illegal, or contrary to any applicable health and safety guidance. 

- Attempt to repair, modify, or tamper with the Equipment. - Expose the Equipment to conditions it is not designed for (e.g. extreme weather, liquids where not appropriate). 

- Use the Equipment commercially or for purposes other than those agreed at the time of booking without our written consent.

4.4 Liability: PlayHaus takes reasonable care to ensure all Equipment is safe and fit for purpose before hire. However, to the fullest extent permitted by English law:

- PlayHaus is not liable for any indirect, incidental, or consequential loss or damage arising from use of the Equipment. 

- Our total liability to you under or in connection with any booking will not exceed the total value of that booking. 

- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

4.5 Your Insurance: We recommend that you hold appropriate insurance to cover accidental damage, loss, or theft of hired Equipment during the Rental Period. PlayHaus does not provide insurance cover on behalf of customers. The Security Hold placed on your payment method does not constitute insurance and does not limit your liability for damage or loss beyond the held amount.

4.6 Supervision & Safety: It is your responsibility to ensure adequate adult supervision of any Equipment used by or near children. PlayHaus accepts no liability for injury or accident arising from unsupervised or improper use of Equipment.

05 PRIVACY POLICY

5.1 Data We Collect: When you make a booking or contact us, we collect personal information including your name, email address, phone number, delivery address, and payment details. We may also collect information about how you use our website.

5.2 How We Use Your Data: 

We use your personal data to: 

 

- Process and manage your booking. 

- Communicate with you about your order, including delivery and collection arrangements. 

- Process payments and manage security holds. 

- Comply with our legal and regulatory obligations. 

- Send you information about our services where you have given us permission to do so.

5.3 Legal Basis: We process your personal data on the basis of contractual necessity (to fulfil your booking), legal obligation, and  where applicable,  your consent. We rely on legitimate interests for business communications directly related to your hire.

5.4 Data Sharing: We do not sell your personal data. We may share data with trusted third-party service providers (such as payment processors or delivery partners) strictly to fulfil your booking. All third parties are required to handle your data in compliance with UK GDPR.

 

5.5 Data Retention: We retain your personal data for as long as necessary to fulfil the purposes described above and to comply with applicable laws (typically up to 6 years for financial and contractual records).

5.6 Your Rights: Under UK GDPR, you have the right to: 

 

- Access the personal data we hold about you. 

- Request correction of inaccurate data. 

- Request deletion of your data (subject to legal retention requirements). 

- Object to or restrict certain processing. 

- Withdraw consent at any time (where processing is based on consent).

5.7 Cookies: Our website may use cookies to improve your browsing experience and analyse site usage. You can control cookie preferences through your browser settings. By continuing to use our website, you consent to our use of essential cookies.

06 GENERAL

6.1 Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

6.2 Changes to These Terms: PlayHaus reserves the right to update these Terms and Conditions at any time. The version published on our website at the time of your booking shall be the most current, accurate, and binding version of these Terms. It is your responsibility to review the Terms before each booking. Continued use of our services following any update constitutes acceptance of the revised Terms.

 

6.3 Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

6.4 Entire Agreement: These Terms, together with your Booking Confirmation, constitute the entire agreement between you and PlayHaus in relation to your booking and supersede all prior communications, representations, or agreements.

6.5 Waiver: Failure by PlayHaus to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
